Public Comment for Temporary Non-Preferred Rule Begins April 3, 2026, Responses Due May 4, 2026

The Texas Health and Human Services Commission (HHSC) will accept public comment on a proposed rule to add drugs with a temporary non-preferred (TNP) status to the Texas Administrative Code. TNP drugs are new-to-market drugs that have been added to the Medicaid formulary but not yet reviewed by the Texas Drug Utilization Review Board. House Bill (HB) 3286, 88th session required the change.

The public comment period for the proposed rule on TNP drugs will begin on April 3, 2026, and remain open through May 4, 2026.

Texas Health and Human Services (HHS) publishes notices in the Texas Register. Interested parties can review and comment on the proposed rule. The Secretary of State publishes a new issue of the Texas Register each Friday.
